Before any other guide, I believe that a "Know your rights" tutorial is needed. I've seen many players that have absolutely no clue on what their rights are in the game, yet they reached max level and above-average gear.
This wall of text will explain what you are allowed to do and what is considered against the rules, in this MMORPG. Only after reading this, should you consider reading other guides, provided that you meet the requirements to play and that the game suits you.
I will mark the text from Agreement with this COLOR and the explanations that you have to know and understand with this COLOR.
READ THIS BEFORE THINKING THAT YOU HAVE THE RIGHT TO DO THIS AND THAT.
CABAL Online AGREEMENT
Last Updated Oct 6, 2009 IMPORTANT! PLEASE READ CAREFULLY.
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND GAMES-MASTERS.COM LTD, BY TICKING THE BOX YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
This agreement was last revised on October the 6th, 2009. You should read it fully at least once, as with any contract in your every day life. A legal agreement is a mutual understanding between two or more legally competent individuals or entities about their rights and duties regarding their past or future performances and consideration. This means that you have to be of Legal Age (18+) in order to accept this agreement and proceed to creating your account. If for any reason the agreement has been signed between an underaged person and GamesMasters.com, the underaged party can cancel the contract via rescission which means for example, that an underage person can cancel a contract because he or she lacks competence to make a contract in the first place. If you are not of legal age, it means you cannot legally accept this agreement and therefore you are not allowed to create the account (without breaking the law ofc).
Welcome to GAMES-MASTERS.COM LTD's massively multi-player on-line role-playing game, CABAL Online ("CABAL Online"). CABAL Online is the copyrighted work of ESTSOFT Corp., licensed for the English speaking European market by GAMES-MASTERS.COM LTDcom ltd. All use of CABAL Online game (the "game") is governed by the terms and conditions contained in this Agreement, including any future revisions (hereafter referred to as the "Agreement"). This Agreement is in addition to, and does not replace or supplant, the User License Agreement that you agree to by using the CABAL Online software (the "ULA") and to which the CABAL Online software is subject.
This paragraph states that Cabal Online and all material included (graphics, storyline, character models, game files, launcher pictures, etc) are property of ESTSoft and not GamesMasters.com. Also, it states that GamesMasters.com has bought the license for the English version of the game only, hence they are not allowed to translate the game into any other language (such as creating Cabal Online FR or Cabal Online NL), without purchasing a new license. This is the reaso why Cabal Online DE an RU have appeared, while within Europe, because their content is not in English, but in the native languages of their respective countries.
It also states that ALL use of the game, from the moment you start the game executable, is governed by this Agreement. Again, if you are not legally allowed to accept this agreement, you have no right to start the software.
1. Account.
A. To register an Account to play CABAL Online, you will be required to provide GAMES-MASTERS.COM LTD with details which they specify and which they may vary from time to time and you must provide accurate information. Failure to provide accurate information or to update it shall constitute a breach of this Agreement, which may result in the immediate termination and deletion of the Account at the sole discretion of Games-Masters.com ltd
In order to create your account and play Cabal, you will have to provide GamesMasters.com with REAL & ACCURATE data, not random numbers and names and birthdates. If you enter random data, or you do not update the info in your account (for example Address or telephone, etc) you automatically ACKNOWLEDGE that you broke the rules stipulated in the Agreement, thus giving GamesMasters.com the freedom to act on your account as they please. In other words, if you do not input valid, real data, GM.com HAS the right to delete your account without giving any explanations.
NOTE: Do not input "asdasdasdasdsa" as Address or 34324234234 as Phone number, as this is an example of why GM.com has the right to terminate your accounts. This means no moaning when your chars get banned or deleted.
B. During the registration process, you will be required to select a user name and a password that are specific to the Account (collectively known as the "Password"). Your Password is to be kept confidential at all times and you are solely responsible for the security of your Password. You may not disclose your Password to anyone, or allow your Password to be used by anyone other than yourself and/or your one minor child. GAMES-MASTERS.COM LTD is not responsible for any harm that may result to the Account (including without limitation the deletion or modification of characters in the Account) as a result of a lost or shared password. The user name you choose shall be subject to the naming guidelines contained in this Agreement. GAMES-MASTERS.COM LTD is not responsible in the event that the Account is "hacked," or if the Account or your computer is damaged by a virus, or for any other issues with your computer or the Account. If you think that the Account has been compromised, please contact GAMES-MASTERS.COM LTD Technical Support, either through our Game Masters or CABAL Online support system.
During registration, you will be able to select a username and a password to your account. Your password should be kept safe, because you are the only one responsible for the security of the password. This also means that GM.com is not responsible for your PC security. You "may" not disclose the password, means that it is not against the rules to disclose it, but it is not advisable either. May represents a present time possibilty (a possibility that you will share the password).
GM.com is not responsible for whatever happens with your account (characters being deleted, items NPCed, etc) as a result of lost or shared password (which assessment will be performed by the staff itself to see if the password was breached or whether it was a self-conscious act of sharing it.
The username you choose must also follow the rules regarding naming, outlined below in this Agreement.
GamesMasters.com is not responsible for anything if your account is breached into (this is a bit vague as hacking can be performed clientside or serverside) or if the account fails victim to a virus or any other malicious software stored on your PC (even unwillingly).
If you have any reasons to believe that the account might be breached (such as items missing, skillbars rearranged, alz gone, etc) you should contact the Support Centre either via in-game GMs or the Website support.cabalonline.com.
C. You hereby agree to pay all charges incurred by the Account, including applicable taxes, in accordance with games–masters billing policy for the Game. Your right to access to the Game is subject to any limits established by GAMES-MASTERS.COM LTD or by your credit card issuer, billing game, 'CABAL Online Game Card Agreement,' or other payment methods authorized by GAMES-MASTERS.COM LTD GAMES-MASTERS.COM LTD may, in its sole and absolute discretion, suspend or terminate your access to the Game and disable or delete the Account, if: (i) payment cannot be charged to your credit card; (ii) your charge is returned to GAMES-MASTERS.COM LTD for any reason; (iii) you are paying by cash and you fail to pay the monthly subscription fee for the upcoming month. If you have a balance due on the Account, you agree that GAMES-MASTERS.COM LTD can charge these unpaid fees to your credit card or debit them from your debit card, as applicable. You agree to reimburse GAMES-MASTERS.COM LTD for all costs and expenses incurred by GAMES-MASTERS.COM LTD in collecting payment due hereunder, including without limitation all bank or game charges, and any reasonable legal fees.
By accepting this agreement, you also agree to pay all and any charges that the Account implies, according to the billing policy set by GM.com (at the moment there is a 0 euro policy, as the game is a Free 2 Play game). Your freedom to access the game is set by both GamesMasters.com as well as the company/bank that issued your credit card (maybe they will deny payments towards GM.com) or any other payment method (such as Moneybookers, PayByCash, etc) should the game require a tax (which as I said, it doesn't, at the moment).
GM.com IS ALLOWED to suspend (ban) or terminate (delete) your access to the game and the account (via IP ban or game account ban, etc)if :
i) Payment cannot be retrieved from your credit card (as I said, the game is now F2P so this does not apply, it's useful for P2P only)
ii) Your payment does not reach GM.com
iii) You pay with cash and you don't get to pay within the time limit imposed by the monthly subscription.
You also agree that GM.com can retrieve any amount of cash from your credit card, as long as you are in debt towards the company.
D. You may establish one user account (the "Account") with which to play CABAL Online by accessing the Game pursuant to the terms, conditions and restrictions contained in this Agreement. You may not share the Account with anyone, except that if you are a parent or guardian, you may permit one minor child to use the Account when not in use by you. You are liable for all uses of the Account. You acknowledge and agree that you shall have no ownership or other property interest in the Account, and you further acknowledge and agree that all rights in and to the Account are and shall forever be owned by GAMES-MASTERS.COM LTD.
This basically means that you have the possibility to establish one user account (Web Account) with which to enjoy the game, but nowhere does it say you are restricted to only one. The modal verb may should not have been used to create confusion about a possible, hypothetical situation.
In other words :
You have the possibility of establishing one account (no limitations imposed though so your possibilities are not enclosed by this).
You do not have the possibility of sharing the account (although no limitations are imposed about this, so the staff did not turn this into an enforcing rule). Also, the sentence is vague, as it does not state : You are not allowed to (which is stronger than you do not have the possibility). The possibility will always exist as long as it is not denied.
You are allowed to permit one minor (below 18) to use the account in your absence.
You are responsible for everything that happens with the account (so if your son is selling Alz from your account, you are legally responsible for any infringements).
You also acknowledge the fact that you DO NOT OWN the account, and you also agree that the only owner of your virtual property is GM.com.
E. GAMES-MASTERS.COM LTD does not recognize the transfer of Accounts, and will result in the permanent deletion of the Account. You may not offer any Account for sale or trade, and any such offer is a violation of this Agreement and may result in suspension or termination of the Account.
GM.com will never accept/recognize/agree with the transfer of accounts between players (aka account selling or WTT 120 WI for 120 FB) and this will result in the deletion of both accounts. You do not have the possibility of legally offering the account for sale or trade, but you are not restricted from doing so either (via mechanics), but do keep in mind the above consequences if you choose to ignore the Terms of Use and proceed, and you are found guilty.
F. There are no refunds where the Account is terminated prior to the end of a subscription period; the Game will be available for your use until such time that the then-current subscription period expires.
This means that GM.com will not refund your euros if you get banned 2 days after buying a new 90 day premium.
2. Limitations on Your Use of CABAL Online.
Your license to use CABAL Online is limited by this Agreement. Limitations on your right to use CABAL Online may include, but not necessarily be limited to, the following:
A. GAMES-MASTERS.COM LTD expressly reserves the exclusive right to create derivative works based on CABAL Online. This means that you may not create derivative works based on CABAL Online, without the prior express, written permission of GAMES-MASTERS.COM LTD
This means that your rights to use the software are limited by this agreement. These limitations can include the below, but are not the only ones that you should be aware of (the moral ones also include, as well as Law Imposed limitations, set by the UK Government in regards to Online Gaming, etc) :
A. GM.com reserves its right of creating derivative works (such as using game content to create their website, icons, etc). You are deprived of the possibility of creating your own websites and any other derivative works (trailers, etc) without prior written consent of GM.com (because they bought all the licenses related to the English version from the developers, otherwise you would've had to request permission from the license owners - ESTSoft).
B. Only ESTSOFT or its authorised representatives including GAMES-MASTERS.COM LTD have the right to host CABAL Online in Europe! Accordingly, you may not host, provide matchmaking games for, or intercept, emulate or redirect the communication protocols used by GAMES-MASTERS.COM LTD as part of CABAL Online. Such prohibited methods may include, but are not limited to, protocol emulation, reverse engineering, modifying CABAL Online, adding components to CABAL Online, or using a utility program to host CABAL Online.
Only ESTSoft and their legal clients (business partners), which includes GM.com, have the right to legally host Cabal Online in EU. Because of this, you are deprived of the possibility of hosting your own server, or to alter the game communication protocols (this also means that you do not have the possibility of using a proxy to mutate network packets, use cheating software, etc).
Such forbidden methods include proxy usage, TCP/UDP emulation and packet alteration, reverse engineering network packets, etc.
C. You agree that you will not (i) modify or cause to be modified any files that are a part of a CABAL Online installation; (ii) create or use cheats, "mods", and/or hacks, or any other third-party software designed to modify the CABAL Online experience; (iii) use any third-party software that intercepts, "mines", or otherwise collects information from or through CABAL Online. Notwithstanding the foregoing, you may update CABAL Online with authorized patches and updates distributed by ESTSOFT.
This stipulates that you agree that :
i) You will not modify any Cabal Online installation files (such as editing game files)
ii) You will not create 3rd party software based on the game, such as cheats, mods, proxies, tools, hacks, which are designed to affect the game itself. You are however allowed to create Damage calculators and such, which are community tools, rather than tools used to gain an unfair advantage towards other players.
D. You may not exploit flawed or unintentional discrepancies in the game mechanics, regardless of any benefits your character may or may not recieve.
You are do not have the possibility to use any game mechanics that are marked as bugs or must-fix issues by the developers, no matter whether it affects your character or not.
This however, means that until that feature is marked as a bug or a must fix, you are not breaking the rules
You are only breaking the rules if you CONTINUE exploiting those discrepancies, AFTER they are marked as flaws (bugs).
E. You may not institute, assist, or become involved in an attack upon any CABAL Online server or otherwise attempt to disrupt the CABAL Online servers. You may not institute any such attack which results in the disruption of any other player's CABAL Online experience. ANY ATTEMPT BY YOU OR ANY OTHER PLAYER ON AN ACCOUNT TRACEABLE TO YOU TO DAMAGE CABAL ONLINE OR UNDERMINE THE LEGITIMATE OPERATION OF CABAL ONLINE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE OR ASSISTANCE FOR SUCH AN ATTACK BE PROVIDED, GAMES-MASTERS.COM LTD RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH USER TO THE FULLEST EXTENT PERMITTED BY LAW. You may not, whether intentionally or unintentionally, violate any applicable local, state, national or international law or regulation in connection with your use of CABAL Online or the Game
You are not supposed to start, support or take part in any way in an attack upon the Cabal EU servers (flooding, security breaching, database injections, etc) or any other action that will disrupt the Cabal online Servers (Such as hijacking the Data Center, shooting down the hamsters that supply the power grid for Dogado etc)
Any attempt, by you or any player that has used your account or one of your accounts or an account that leads to yours, of damaging the aforementioned parties, will be treated as a violation of criminal and civil laws, meaning you are screwed, and that GM.com can file a lawsuit against you and ask for damage refund to the maximum permitted by the local laws.
3. CABAL Online Rules of Conduct.
CABAL Online is governed by certain rules of conduct that must be adhered to by all users of CABAL Online. It is your responsibility to know, understand and abide by these rules of conduct. The following rules are not meant to be exhaustive, and GAMES-MASTERS.COM LTD reserves the right to determine which conduct it considers to be outside the spirit of the game and to take such disciplinary measures as it sees fit up to and including termination and deletion of the Account. GAMES-MASTERS.COM LTD reserves the right to modify these Rules of Conduct at any time.
The following rules of conduct will be enforced by this agreement. It is your responsabilty to know them, understand them and follow them. GM.com also reserves the right to be subjective about cases and decide wether the behavior was outside the acceptable boundaries and to take measures as it sees fit. This means that you can get a permanent ban on the first insult, depending on seriousness. You can't curse someone heavily, knowing that you will get a 3 day ban, just because that's the punishment for 1st time offense. These rules are prone to change and the POLICY rules are just a hint, a schematic of what you should expect, not of what will happen. The decision is GM.com's in the end, as they will judge the severity of the conduct breach.
A. Rules Related to User Names.
Each user will select a character name. Additionally, users may form "guilds" and such guilds will be required to choose a name for the guild. When you choose a character name, create a guild, you must abide by the following guidelines as well as the rules of common decency. If GAMES-MASTERS.COM LTD finds such a label to be offensive or improper, it may, in its sole and absolute discretion, change the name and/or suspend or terminate your use of CABAL Online.
In particular, you may not use any name:
1. Belonging to another person with the intent to impersonate that person, including without limitation a "Game Master" or any other employee or agent of GAMES-MASTERS.COM LTD;
2. Belonging to any religious figure or deity;
3. Subject to the rights of any other person or entity without written authorization from that person or entity;
4. That belongs to a popular culture figure, celebrity, or media personality;
5. That is, contains, or is substantially similar to a trademark or game mark, whether registered or not;
6. Related to drugs, sex, alcohol, or criminal activity;
7. That incorporates 'swear' words or which are otherwise offensive, defamatory, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable;
8. Comprised of partial or complete sentence ;
9. Comprised of gibberish ;
You may not use a misspelling or an alternative spelling to circumvent the name restrictions listed above, nor can you have a "first" and "last" name that, when combined, violate the above ame restrictions.
The users will select character and guild names, but they must use the below guidelines as well as common decency rules (dictated by each person's morality). If GM.com says that your chosen name is offensive or improper (and yes, this is subjective as well, it's not something fixed), then it can change the name or even delete your character/guild/account. (this is in regards to what happend on Mercury where a bunch of players named their guild after a rivaling MMO game, and got their name changed to **** ).
You are not allowed to use :
1. Names that belong to another person (for example you cannot create a character that is someone's name in real life, etc) with the intention to impersonate. This includes names as Administrator, GMKru, GAxxxx, SystemSupport, etc.
2. Names that relate to religious figures (such as Jesus or Buddha or Muhhamad, etc) or ThePope or similar
3. didn't find a good example, sorry
4. You cannot use names like Michael Jackson or Oprah or Obama or anything else (I've seen some pets named like this and they should be changed)
5. Names that are registered trademarks, like Nike or Pepsi or McDonalds, etc or other names of products, virtual or not, like Diablo or MaxPayne, etc.
6. Names like Cocaine, Weed, iSmokeWeed, Ballantines, AlCapone, etc
7. Names like Prostitute, Nigg .. you know the rest, etc
8. Names like ILoveSex
9. Names like ILoveFvcking or S3xMeHard or God knows what else.
4. Rules Related to "Chat" and Interaction With Other Users.
Communicating with other Users and GAMES-MASTERS.COM LTD representatives is an integral part of CABAL Online and is referred to in this document as "Chat." Your Chat sessions may be subject to review, modification, and/or deletion by GAMES-MASTERS.COM LTD without notice to you. Additionally, you hereby acknowledge that GAMES-MASTERS.COM LTD is under no obligation to monitor Chat, and you engage in Chat at your own risk.
This part is pretty much self-explanatory, you are responsible for all the chatting you involve yourself into.
In judging the following it will be done in the sole and absolute opinion of GAMES-MASTERS.COM LTD. When engaging in Chat in CABAL Online, or otherwise utilizing CABAL Online, you must not:
(i) post any content or language which is deemed to be offensive, including without limitation content or language that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, sexually explicit, or racially, ethnically or otherwise objectionable, nor may you use a misspelling or an alternative spelling to circumvent the content and language restrictions listed above;
This means you should not post/type any content or words that are labeled as offensive, including threats, harassments, insults, racist, obscene, etc. Things as noob and "**** .. <insert nation here>" will be considered insults, as well as "Shut up or I go kill your dog" and similar sentences.
Also, if you use "***" or "Fvck" or "Fack" as alternatives (just an example), because they are intentional misspellings and will be treated as the base word itself.
(ii) Disrupt the normal flow of dialogue in Chat or otherwise act in a manner that negatively affects other users including without limitation posting commercial solicitations and/or advertisements for goods and game available outside of the CABAL Online;
You are not allowed to interrupt the users that are chatting, via advertising goods that are not related to Cabal Online.
For example, if you would interrupt a chat on TheNest with WTB Tita Helm, that would be ok, up to a point, even if it would be rude. But if you would interrupt with Buy free alz here >Link<, then you can even be banned for it.
(iii) Carry out any action with a disruptive effect, such as intentionally causing the Chat screen to scroll faster than other users are able to read, or setting up macros with large amounts of text that, when used, can have a disruptive effect on the normal flow of Chat;
This means that you are not allowed to "spam" where spam can be repeating the same line over and over again, the same word, typing random letters, characters, etc. I would consider spam something that is quite similar and spreads over 3 - 4 rows consecutively. Someone formulating sentences that have verbs and subjects and so on, is not considered spamming, no matter on how many rows it takes him to write it. Spamming is REPEATING something, not chatting lively.
(iv) Use bots or other automated techniques to collect information from CABAL Online or any forum or website owned or administered by GAMES-MASTERS.COM LTD;
This is pretty much selfexplanatory. Also, I would categorize Verdian's signature as violation of this rule, because he basically extracts information from the GuildBoard and then provides it (both freely and via cost) to the users. But as long as he had a green light from GM.com to do so, I guess it's ok. Otherwise, it would be a breach of the rule if you would do it without GM.com consent.
(v) Communicate or post any user's personal information in or on the CABAL Online, or websites or forums related to CABAL Online, except that a CABAL Online user may communicate his or her own personal information in a private message directed to a single user;
This means that you are not allowed to post any personal information about anyone (such as personal pictures or personal details about someone). This reminds me of the time when people posted pictures of various players without asking for their permission, or when an ex-GA used his forum rights to share information about the identity of the newly hired GameMasters (me included, at that time). Such actions can be punished with a termination of the account, if the GMs are disturbed by it.
(vi) Sending repeated unsolicited or unwelcome messages to a single user or repeatedly posting similar messages in a Chat area, including but not limited to continuous advertisements to sell goods or games;
This is pretty much selfexplanatory, it relates to how the alz-spammers fill the screen and how players get whispered to buy alz by lvl 1 chars and so on.
(vii) Harass, threaten, stalk, embarrass or cause distress, unwanted attention or discomfort to any user of CABAL Online
This is related to the case when one user keeps whispering/shouting/using normal chat to cause unrest towards any other user. This includes calling players names (you noob, capellas noobs, you are ******, shut up noob, shut up or I slap you (yes, i had that
) and many other examples)
(viii) Our Staff have the right to work and live without the threat of physical violence or abuse or verbal attacks in game and out of the game.
The paragraph explains how the staff (and I believe this also includes Game Advisors, as they are unpaid staff or .. assistants) should not be threatened to be beaten or should not be insulted in-game (ex: ****** GAs, GAs don't know anything, crap GA, etc).
(ix) Games-Masters.com Ltd. have 'virtual domiciliary rights' for avoidance of disturbances, which we employ as necessary - including the complete and full exclusion of a customer from playing our games.
(x) Any forums operated by GAMES-MASTERS.COM LTD may have their own terms of use.
These 2 are pretty much selfexplanatory. Basically, if any GM wakes up one morning and decides that he doesn't want you to play the game that he as an institution is hosting, then you will no longer be able to play it. Furthermore, they are not obliged to give any explanations to this.
The forums also have their own set of rules, besides these ones, so be sure to check them out, in Caesar's post about Forum Rules.
5. Consequences of Violating the GAMES-MASTERS.COM LTD Code of Conduct.
GAMES-MASTERS.COM LTD may, in its sole and absolute discretion, take whatever action it deems necessary to preserve the integrity of CABAL Online. Violation of any of the terms and conditions set forth above may result in actions being taken by GAMES-MASTERS.COM LTD, effective immediately or at a time determined by GAMES-MASTERS.COM LTD, which may include without limitation: (i) temporarily suspending your access to CABAL Online, or (ii) permanently terminating your access to CABAL Online. Without limiting the foregoing, GAMES-MASTERS.COM LTD retains the right to decline game to any user who violates the Agreement.
This basically says that you agreed when signing, with the fact that GM.com may temporarily block your account for any reason they deem worthy, or they may even delete your account completely.
Also, GM.com reserves the right to decline (if that's their wish) your rights of using one of their accounts to play this game, if you have broken the Agreement. (I know for one that I broke it several times, but thankfully, haven't pissed them off that much as to block me :* ... yet)
6. Experience/time Reimbursement.
Nothing in these rules will place a "duty" or requirement upon GAMES-MASTERS.COM LTD to reimburse you by providing experience credit or free game play time for any reason.
This stipulates that GM.com will not be forced in any way to provide reimbursments. This means that if the servers go down for 2 weeks, they are not obligated to provide refunds, and that if they choose to do so (as it has happened before, with the free premium days) it's because of their own will and marketing strategy, and not some contractual clause.
7. Termination.
This Agreement is effective until terminated. Either party may terminate this Agreement immediately by delivering to the other party written notice of such termination or by terminating the Account. In the event that you terminate or breach this Agreement, you will forfeit your right to any and all payments you may have made for pre-purchased game access to CABAL Online. You agree and acknowledge that you are not entitled to any refund for any amounts which were pre-paid on behalf of the Account prior to any termination of this Agreement. GAMES-MASTERS.COM LTD reserves the right to terminate this Agreement without notice, if, in GAMES-MASTERS.COM LTD's sole and absolute discretion, you fail to comply with any terms contained in these Agreement.
In other words, this agreement lasts as long as both parties agree to the terms inside it. When either you or GM.com will decide to end it, then you will be free to act as you please.
Also, you may choose to terminate such agreement by sending a written notice (a ticket to account support) that you wish for your account to be terminated, thus releasing yourself from this legal contract.
If you terminate the agreement, you will give up on your invested money, time, effort, etc, as well as any existent Cabal Cash on your account, which represents the pre-invested funds.
You also agree that you will not ask for a refund, and you also agree that GM.com also has the right to do so, not only you as a player, even without notifying you of their decision.
8. Online Duration.
GAMES-MASTERS.COM LTD will provide the game whilst is has the license to do so and will give 30 days notice of any intension it has to stop providing the service.
This means that GM.com will only provide the game for as long as they have the license covered, and that they are forced to give a 30day notice if the license is not extended further.
9. Changes to the Terms of the Agreement.
GAMES-MASTERS.COM LTD reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement at any time, including, without limitation, access policies, the availability of any CABAL Online features, hours of availability, content, data, software or equipment needed to access CABAL Online, the amount of, or basis for determining, any fees or charges for CABAL Online, and institution of new fees or charges for CABAL Online, effective upon prior notice as follows. GAMES-MASTERS.COM LTD will post notification of any such changes to CABAL Online on the CABAL Online website and will post any revised Agreement in this location, and may provide such other notice as GAMES-MASTERS.COM LTD may elect in its sole and absolute discretion, which may include by email, postal mail, pop-up screen, or in-game notice. If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you may cease to use your CABAL Online account and terminate the Account. The continued use of CABAL Online by you following any one of the above notices of changes to this Agreement will mean you accept any and all such changes. GAMES-MASTERS.COM LTD may change, modify, suspend, or discontinue any aspect of CABAL Online at any time. GAMES-MASTERS.COM LTD may also impose limits on certain features or restrict your access to parts or all of CABAL Online without notice or liability. You have no interest, monetary or otherwise, in any feature, content or availability of CABAL Online, any Game Data or in any terms or conditions of access to or use of CABAL Online.
This pretty much reffers to the fact that the Terms of Agreement can and WILL change from time to time, so make sure you are up-to-date with the latest contractual clauses. This means : READ THIS S*** from time to time, before yelling that you're banned for no reason. KKTHX.
11. Ownership.
All title, ownership rights and intellectual property rights in and to CABAL Online (including without limitation any user accounts, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, "applets" incorporated into CABAL Online, transcripts of the chats, character profile information, recordings of games played on CABAL Online, and the CABAL Online client and server software) are owned by GAMES-MASTERS.COM LTD/EstSoft Corp, CABAL Online is protected by the copyright laws of the United Kingdom/ international copyright treaties and conventions, and other laws. All rights are reserved. CABAL Online may contain certain licensed materials, and GAMES-MASTERS.COM LTD's may protect their rights in the event of any violation of this Agreement. You have no the right to "sell" CABAL Online content, including your character or in game items(other than in the normal coarse of game play within the game). Any attempted sale is a breach of this agreement.
This paragraph tells us how the GMs own your virtual ***** and that you are not allowed to sell your account or items or alz or pedopanda pet on e-Bay or whatever.
12. Acknowledgments.
You hereby acknowledge that:
A. The Cabal client may monitor your computers RAM and CPU for unauthorised third party programs and report back to games-masters.com information about this and your cabal details. If such a program is detected it will constitute a breach of the agreement
B. You assume the cost of all telephone and Internet access charges along with all necessary equipment, servicing, repair or correction incurred in maintaining connectivity to CABAL Online's servers.
C. GAMES-MASTERS.COM LTD has the right to obtain certain identification information about your computer and its operating system, including the identification numbers of your hard drives, central processing unit, IP addresses and operating systems, for identification purposes without any further notice to you.

This is a bit interesting. You agreed that :
A) GM.com may scan your PC for running cheats and ban you for it
B) You will pay all the bills needed to access Cabal Online
C) GM.com has the right to obtain your hardware serial numbers and so on for identification purposes, if that is their wish. Yes, they can trace your ***** across the Internet if they really want to do it.
D) They can gather info on your connection speed, PC speed, etc for comparison and such
E) They own every bit of information uploaded by your Client to the servers
F) You are aware of the fact that Cabal Online will not be running 24/7/365 a year, and that you may not access Cabal whenever you feel like it (to be read : Maintenance extensions).
13. Returns Policy
There is no returns policy.
This one's easy : Since there's no sold product (like a DVD or anything), as everything is digital distribution (downloadable client) then you do not have any returns policy. Ciao.
15. Laws
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law.
Due to the fact that GM.com is founded in the UK, it submits itself to Brittish laws, not your custom laws. This reminds me of the funny case of a player from Mercury who sued GM.com because in his country there were laws against online gaming whereas they were null in the UK. :-)
16. Miscellaneous.
This Agreement is the complete and exclusive statement of the agreement between you and GAMES-MASTERS.COM LTD concerning the Game, and this Agreement supersedes any prior or contemporaneous agreement, either oral or written, and any other communications with regard thereto between you and GAMES-MASTERS.COM LTD; provided, however that this Agreement is in addition to, and does not replace or supplant, the End User License Agreement that accompanied the CABAL Online software. This Agreement may only be modified as set forth in Section 10. GAMES-MASTERS.COM LTD will cooperate fully with all governmental authorities and any lawful orders of the court or other legal process with regard to the release of information that relates to you and/or your use of CABAL Online, including without limitation user Internet Protocol (IP) addresses, associated personal information and all other user information on file. You represent that you are a 'natural person' who is over the age of eighteen (18) years old, or over the age of majority in the country where you are a citizen, and agree to these Agreement on behalf of yourself and, at your discretion, for one minor child for whom you are a parent or guardian and whom you have authorized to use the account you create on the Game (the "Account"). I hereby acknowledge that I have read and understand the Agreement Agreement and I agree that my use of the CABAL Online game is an acknowledgment of my agreement to be bound by the terms and conditions of this Agreement.
This paragraph gave me a huge headache and therefore won't explain it in detail. The main thing in this wall of text is :
You represent that you are a 'natural person' who is over the age of eighteen (18) years old, or over the age of majority in the country where you are a citizen, and agree to these Agreement on behalf of yourself and, at your discretion, for one minor child for whom you are a parent or guardian and whom you have authorized to use the account you create on the Game (the "Account").
In other words, if you are under 18 or age of majority in your country, then you're not allowed to play this game, as you are not allowed to agree with this legal contract, since you're a juvenile :*)
If you want to play this game, you have to have parental consent, written consent, sent to GM.com (meaning that your mom or dad or bigger brother must enter their accurate data in the account details, in order for it to not be deleted by GM.com).
